NV JETS CHARTER SERVICE AGREEMENT
1. Fees/Charges. Client agrees to pay the fees/charges set forth on the quote enclosed herewith, in addition to any additional/optional charges incurred as set forth in Section 6 below.
2. Payment Information. Payment in full is due prior to departure. Absent receipt of payment prior to departure, delays will result and will require payment of additional fees/charges (see Section 6 below).
2.1 Wire Transfer. NV Jets’ preferred method of payment is wire transfer at the following:

2.2 Credit Card Authorization. Absent receipt of payment by other authorized method, Client hereby authorizes NV Jets to immediately debit the credit card account entered.
Due to merchant services fees, a four percent (4%) fee will be added to any quoted charges when paid with a credit card.
A photocopy of the front and back of the above-referenced credit card and the driver’s license or other identification of the cardholder must be provided to NV Jets no later than seventy-two (72) hours prior to agreed upon departure time. A copy of the credit card and identification will be kept on file with NV Jets. Failure to provide the above copies may delay your itinerary.
By signing, Client authorizes NV Jets to debit the foregoing credit card account in the amount set forth in Section 2 above and the quote enclosed herewith, in addition to any additional/optional charges incurred as set forth in Section 6 below.
Client further authorizes NV Jets to note “signature on file” on any charge tickets for purchases/services requested by Client or Client’s authorized representative(s).
3. Unavailability. In the event aircraft becomes unavailable for any reason (including without limitation maintenance or scheduling conflicts) NV Jets will endeavor to secure alternative options and will provide an alternate quote upon Client’s approval of the replacement aircraft.
4. Repositioning Legs. In the event that the aircraft must reposition to and/or from to accommodate the individuals booked request, there is no ownership of the repositioning flight. It is at NV Jets sole discretion to allow the sale and/or price of such repositioning and such third-party ownership or sale shall be strictly prohibited unless in writing.
5. Cancellation. A written request for cancellation must be received no later than forty-eight (48) hours prior to agreed upon departure time. All cancellations within forty-eight (48) of agreed upon departure time will result in a cancellation fee equal to 100% of the quoted charges.
Upon booking multiple day, multiple leg trips forty-eight (48) hours shall commence at the beginning of the first day/leg of trip. Any significant changes to the itinerary, in the sole discretion of NV Jets, will be treated as a cancellation and the above-noted cancellation fee shall apply.
All Empty Leg quotes are final and are not included in the above cancellation policy.
Trips booked to occur during a Peak Activity Period are subject to a cancellation fee equal to 100% of the quote total.
"Peak Activity Period" shall mean the following periods:
Memorial Day - Extends from the Thursday preceding Memorial Day through and including the following Tuesday
Fourth of July - Extends from the July 1 through and including July 7
Labor Day - Extends from the Thursday preceding Labor Day through and including the following Tuesday
Thanksgiving - Extends from the Wednesday preceding Thanksgiving Day through the following Tuesday
Christmas - Extends from December 18 through and including December 31
New Year - Extends from January 1 through and including January 5
6. Additional Charges. Quoted charges for flight services set forth on the quote enclosed herewith do not include the following optional/additional items, which will require payment of additional fees:
6.1 Weather-Related Expenses including, without limitation, de-icing and hangar charges;
6.2 Catering/food and beverage services, including consumption of alcohol provided by NV Jets;
6.3 After-hours operation (normal operation hours are between 8:00 a.m. and 10:00 p.m. Pacific Time);
6.4 In-flight telephone services;
6.5 FBO changes/charges including all FBO’s in Las Vegas, NV;
6.6 Itinerary changes;
6.7 Customer special requests;
6.8 GPU (Ground Power Unit) and/or APU (Auxiliary Power Unit) operation during Client delays in excess of one hour ($50 per hour following first hour);
6.9 Wait time will be charged at $300 per fifteen (15) minute increment beyond agreed upon departure time.
6.10 Cleaning and/or repair of damaged/soiled aircraft surfaces, components, appliances, and accessories, including without limitation food/beverage spills, pet damage and odors, stains, and related items.
6.11 Quote does not include the full amount for Additional Expenses. Landing/ramp, international fees, handling and parking fees are included in the quote as a best estimate only. Client shall be solely responsible for payment of Additional Expenses. Deicing, parking, hangar (as a result of inclement weather), flight phone, international Wi-Fi, international fees, handling, parking, landing and catering will be charged to the client after the completion of the flight if applicable.
7. Emergency Contact. Emergency contact information is required as a safety precaution and to ensure compliance with NV Jets’ Safety Management System. Please provide an emergency contact and phone number.

7.1 TSA Compliance, Identification and Travel Documentation: NV Jets is required to verify that none of our passengers are on the Do Not Fly List (the “DNFL”) or the Selectee List. If a passenger appears on the DNFL or the Selectee List, client will be notified and the trip will be cancelled. The applicable cancellation fee will be charged in accordance with NV Jets’ cancellation policy set forth in these terms and conditions. It is responsibility of the client to ensure that all passengers have valid/current government issued photo ID and for international flights Passports/Visas. Photo identification is required for adults 18 and older. Pilots will verify ID, and boarding access will be denied to passengers without proper identification in NV Jets’ sole discretion.
8. Prohibited Items. The Transportation Safety Administration and Department of Homeland Security prohibit certain items on aircraft.
Attached hereto as Exhibit A is a current listing of prohibited items. By signing, Client acknowledges receipt of Exhibit A.
9. LIMITATION OF LIABILITY. IN NO EVENT WILL NV JETS BE LIABLE TO CLIENT OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM THE USE OF NV JETS’ AIRCRAFT OR OTHERWISE ARISING OUT OF THIS AGREEMENT. IN NO EVENT WILL NV JETS’ AGGREGATE LIABILITY TO CLIENT PURSUANT TO THIS AGREEMENT EXCEED THE TOTAL SUM OF ANY CHARGES/FEES RECEIVED BY NV JETS FROM CLIENT AT THE TIME ANY CLAIM AGAINST NV JETS IS MADE.
10.1 Governing Law and Venue. This Agreement shall be governed by the laws of the State of Nevada and any legal action arising from this Agreement shall be litigated in the appropriate federal or state court located in Clark County, Nevada.
10.2 Attorneys' Fees and Costs. If any arbitration, litigation, action, suit or other proceeding is instituted to remedy, prevent or obtain relief from a breach of this Agreement, or pertaining to a declaration of rights under this Agreement, the prevailing party shall be entitled to recover all its reasonable attorneys' fees and costs incurred in each and every such action, suit, or other proceeding, including any and all appeals or petitions therefrom.
10.3 Severability. Should any provision in this Agreement be determined to be invalid, the validity of the remaining provisions shall not be affected thereby, and the invalid provision shall be deemed not to be part of this Agreement, and all remaining provisions shall remain valid and enforceable.
10.4 Entire Agreement. This Agreement constitutes a single integrated written agreement that sets forth the entire agreement between NV Jets and Client and supersedes any prior oral, written, or implied agreements between the NV Jets and Client pertaining to the subject matter of this Agreement.
10.5 No Oral Modification or Waiver. No modification or waiver of the terms of this Agreement shall be effective unless it appears in a writing signed by NV Jets and Client.
10.6 Interpretation of Agreement. The language of all parts in this Agreement shall be construed as a whole, according to fair meaning, and not strictly for or against any party. All parties participated in the drafting of this Agreement. The headings provided in boldface are inserted for the convenience of the parties and shall not be construed to limit or modify the text of this Agreement.
10.7 Successors. This Agreement shall be binding upon the parties, and their representatives, executors, administrators, successors, and assigns, and shall inure to the benefit of each and all of the parties, and to their representatives, executors, administrators, successors, predecessors, parents, subsidiaries, affiliates, employees, attorneys and assignees.
10.8 Counterparts. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Furthermore, signatures delivered via facsimile transmission or PDF shall have the same force effect as the originals thereof.

The following items are PROHIBITED at all time on any NV Jets aircrafts in accordance with Transportation Safety Administration and Department of Homeland Security requirements:
•Explosive and Incendiary Materials:
Gunpowder (including black powder and percussion caps), dynamite, blasting caps, fireworks, flares, plastic explosives, grenades, replicas of incendiary devices, and replicas of plastic explosives.
Guns are not permitted to be carried, concealed or otherwise as carrying a firearm onto the secured area of the air -field where you board a private jet could lead to your arrest
Gasoline, gas torches, lighter fluid, cooking fuel, other types of flammable liquid fuel, flammable paints, paint thinner, turpentine, aerosols (exceptions for personal care items, toiletries, or medically related items).
•Gases and Pressure Containers:
Aerosols (with the exception of personal care items or toiletries in limited quantities in containers sized three ounces or smaller), carbon dioxide cartridges, oxygen tanks (scuba or medical), mace, tear gas, pepper spray, self-inflating rafts, and deeply refrigerated gases such as liquid nitrogen.
All matches are banned from baggage and strike-anywhere matches are banned completely from aircraft, but you can have a single book of safety (non-strike anywhere) matches with you in the passenger cabin.
•Oxidizers and Organic Peroxides:
Bleach, nitric acid, fertilizers, swimming pool or spa chemicals, and fiberglass repair kits.
Weed killers, pesticides, insecticides, rodent poisons, arsenic, and cyanide.
Medical laboratory specimens, viral organisms, and bacterial cultures.
Drain cleaners, car batteries, wet cell batteries, acids, alkalies, lye, and mercury.

•Other Dangerous Items:
Tear gas, spray paint, swimming pool or spa chlorine, and torch lighters.
The Samsung Galaxy Note7 device is a forbidden hazardous material under the Federal Hazardous Material Regulations (HMR; 49 CFR Parts 171-185).
ALL NV JETS CREWS RESERVE THE RIGHT TO QUERY ALL PASSENGERS ON THE PHONES THEY ARE CARRYING WITH THEM EITHER ON THEIR PERSON OR IN THEIR LUGGAGE. NV JETS WILL NOT BOARD ANY PERSONS WHO REQUEST TRANSPORTATION WHO CARRY THE SAMSUNG GALAXY NOTE 7 DEVICE.
